Simon Howarth and Alex Echlin succeed in the Court of Appeal. The Court dismissed the Claimants’ appeal in Anderson v Sense Network [2019] EWCA Civ 1395. This is the first appellate authority on section 39 FSMA and also contains important discussion of the definition of an Unregulated Collective Investment Scheme.
