Bilal and Malik v St George’s University Hospital NHS Trust [2023]

The Court of Appeal handed down judgment this morning in Malik v St George’s. Andrew Post KC, leading Matthew Barnes, acted for the successful Respondent.  Andrew has prepared a case note which highlights three significant issues:

1. the importance of pleadings,
2. the limits on the principle in Wisnieski
3. the interplay between Bolam and Montgomery
