Simon Howarth KC and Lucile Taylor have obtained permission to appeal to the Supreme Court in the case of KVB v Jacobs Hopkins McKenzie, a significant case in relation to section 39 FSMA and the liability of principals in respect of the conduct of appointed representatives. The Supreme Court will be asked to consider the relationship between the KVB judgment and the earlier case of Anderson v Sense Network. The KVB decision has already been the subject of considerable comment from those who act in this difficult area.
